witr. Yes or no for a makeup

Q. is witr necessary to make qadha off? I was told not to make it up for there is no make for it. (Text Message)

A.  Jamhoor: Imaams Shafee, malik and hambal say that make up is not wajib

Imaam Abu Hanefa states that make up for witt is necessary.

When two options exist, it is best to follow the one that has more precaution attributed towards it. If you are a hanafee, then you would certainly do a makeup for witr.

If you are of the other mazahabs, the choice would be yours, since you are not bound by a makeup.

kohl

Q. Can surmah kohl to be worn out of the home for men and woman? Is it only for woman?

A.Yes, men and woman can both adorn themselves with kohl.

For woman, it should not be worn to make themselves look attractive to strangers. It should be done with the intent that it is sunnah, and that their exists a possibility that it can strengthen the eyes, so as to increase a persons ibadah towards Allah (Subhanahu Wata’Ala).

live in the world or leave the world?

Q. Salaams Mulana
In need of Advice as soon as you can. My daughter is 22 years , had a terrible car crash now on life support. Doctors say she is brain dead. Can we switch of life support? Donate her organs? Awaiting reply. Jazakallah. Make dua for family please. Allah hafiz

Time Sent: Wednesday June 17, 2009 at 2:00 am

A. Debate exists as to whether brain or heart stoppage constitutes death. We do believe that varying health support systems do justice for patient recovery. Should good pious doctors feel that such a support system would prove detrimental to patient well being, the family should be consulted with. Upon mutual consultation a decision should be made.

As for organ separation, we have already given a general answer, kindly refer to it.

Contact your local mufti for technical aspects of our underlying response. We do have a more detailed response which we would make public in the appropriate time. We would not like our answer to influence any type of immediate decision on matters of life and death. The above answer would suffice with mutual consultation of a doctor, the family, and your local qualified mufti.

A. The articles convey their messages in a very articulate and precise manner. Their clarity is obvious to every rational non-emotional individual. What opinion do you really want us to share?

Ignorance is not bliss

Question: Asalamulaikom
This question is kind of confusing since it’s not even my question but a friends it will be hard to explain ( i myself don’t really get what she is asking) Can a woman set her own Mahar during marriage? The time she got engaged she did not even know what mahar was…but since it is the woman s right can she decide for her self, even after her engagement and when her mahar was decided by relatives. Can she change the amount of mahar? make it more or less? maybe even change the type of currency?

Time Sent: Tuesday June 16, 2009

Look before you leap

?????? ?????? ????? ???? ???????

May Allah reward you for your questions:
Q.1 Can a woman set her own Mahar during marriage?

A. A woman can set her mehr amount prior to the nikah. If the amount she chooses is too low, her wali (compassionate guardian) can make the appropriate changes.

Allah Certainly Knows Best.

Q. 2 The time she got engaged she did not even know what mahar was…but since it is the woman s right can she decide for herself, even after her engagement and when her mahar was decided by relatives….

A. Ignorance of the law is not bliss. Being ignorant of her rights, more so when a woman is not  a minor at the time of marriage is not a valid excuse. Persons choosing marriage must be aware of their marital rights and obligations.  A woman not requesting what was her right does not give her the ability to negate or increase her mehr amount once she had agreed to its stipulated amount.

If her guardian took part in foul play to marry her off against her wishers, toyed with her mehr and its amount, then the matter would be different. The fact that relatives got together in deciding its amount for you shows that a discussion took place as to the fixing of the mehr. If a woman is old enough to get married, she is old enough to know her rights to an Islamic marriage.

Added to the above, Islam calls upon a woman to get married with her consent and the consent of her wali (compassionate guardian.)  As known, a wali is that person that has a brides best interest at heart. The wali must negotiate this amount and help her understand its significance. If the wali failed in this matter, he is to be held responsible. (poor guy cannot always be blamed!)

Allah Certainly Knows Best.

Q.3 Can she change the amount of mahar? Make it more or less?

A. Once an amount has been agreed upon, than that would be the fixed amount he must give his bride. If she so wishers, she can forgo all or part of it.  If she requests a greater amount to the one stipulated at the time of nikah, and the groom agrees to the new higher amount, then he would be bound by this new agreement.

Should a higher amount be agreed upon and a divorce took place prior to the consummation of nikah, he would be bound by the original contract which comprised of the lesser amount. Non-consummated marriages resulting in divorce also makes the agreed amount become half. E.g. 10 000 would become 5000. It is best to have all changes and transactions in writing.

According to Imaam Abu Hanifa, if she reduced the amount, the Wali (Compassionate guardian) can ask for an increase in her favor, more so if wali feels that she made an immature decision.

Allah Certainly Knows Best.

Q.4 can the female) maybe even change the type of currency?

A. The groom would be held accountable to the currency they had agreed upon. Mehr is her money. She can convert the currency if she wishers once her mehr is received by her. If they alter this original agreement as to the place or country in which the money is to be received, that too would be allowed.

Seeing the best of the best (pbuh)

Q. asalamulaikom
this question reminds me.. can a person have (see) Allah (swt) in their dream. I was told “no” a few years ago and was told that it’s shaytan that comes in that form. But how is that possible? What about prophet (pbuh) can he come to our dream in another person’s form (someone we know)? since shaytan cannot come in his(pbuh) form?

A. No person has ever seen Allah (Subhanahu Wata’Ala). It is possible for people to see the Noor of Allah. Shaytan cannot come in the ‘form’ of Allah (Subhanahu Wata’Ala) for Allah does not have a physical form.

As for seeing Rasulullah (sallallaahu alayhi wa sallam) in the dream, one can see him (sallallaahu alayhi wa sallam) if they are blessed. As you have noted, shaytan cannot resemble Rasulullah(sallallaahu alayhi wa sallam) (Hadith). Rasulullah (sallallaahu alayhi wa sallam) would be seen in his (sallallaahu alayhi wa sallam) genuine form, not in the form of another person. Shaytan can come in the dream of ordinary people (not our Prophet) and act as a pious person to deceive an individual — one must not be fooled with such fake piety.

Seeing Rasulullah (sallallaahu alayhi wa sallam) does not mean that we would all see him (sallallaahu alayhi wa sallam) in the same manner and precision. Our seeing him (sallallaahu alayhi wa sallam )is relational to our Imaan. The stronger our Imaan and love for him (sallallaahu alayhi wa sallam) coupled with good deeds, the more clear our vision would be of him (sallallaahu alayhi wa sallam).

the month you have your dream sometimes does matter

Q. I was having my head shaven in my dream. What is the meaning of this dream?

A. The months of hajj are shawal, zil-Qadah and zul-hijjah. Sacred months are zulqadah, zul-hijjah, muharam and rajab. Should you see yourself having your head shaving in these months, then it means that finances would be lost, or monies of your employer would be lost. It could even mean that you may lose your employment.

Had this dream taken place in the month of Hajj, it would indicate that something good is to come your way. It could also mean that you may go for the pilgrimage (hajj).

if you don’t miss, you don’t make up

Q. Salaam ul aikum wa rahmatullahi wa barakatu,

If one misses a fard prayer, do they have to repeat the sunnah prayer/s that goes with the fard or do they just make up the fard part? Could you give your answer in regards to all madhabs?

Answer: ?????? ?????? ????? ???? ???????

  • The only general difference is in the aspect of Witr and the two rakats of Fajr.  If the fajr was missed due to over sleeping, then Ahnaf are of the opinion that the 2 missed sunnah too must be performed upon awakening. Once
  • All mabhabs agree as to the necessity of making up missed prayers.
  • the time has extensively lapsed, one needs to only make up the fard. Should a person wish to perform the missed two rakats, they can do so.
  • Shafees can voluntarily make up the Witr, while ahnaf call for it to be made up as part of ones Qadah. Thus, to error on the side of caution, witr should also be made up is missed.
  • If one wishers to read the sunnah muakadah, they may do so if the salah missed are few. However, that is not part of the obligation of missed prayers, more so if there are many Qadha prayers putstanding.
  • During the battle of Khandaq, Rasulullah (sallallaahu alayhi wa sallam) missed four salah. He ((sallallaahu alayhi wa sallam) only performed the fard, thus some scholars state: if a person missed few prayers, they can add on the sunnah muakadah, however, it would be more preferred for them to read the missed fard prayers instead.
  • If you are in great health and feel that you are capable of completing all your missed salaah, then in such a situation you can also fulfill all the sunnah that go with each missed prayer. Your first priority should always be towards that which you owe Allah (Subhanahu Wata’Ala) and we owe qadha more then sunnah muakadah! Main thing for true believer is that they perform their Qadah before passing away.
