some things you cannot do

Q. Can a parent disown a child from inheritance?

A. If a child remains a muslim, s/he cannot be declined an inheritance. A parent can give the money to whomever they want whilst the parents are alive. Death calls for religious distribution of wealth.

Burial costs — dying is not cheap in the USA!

Reality of life begins at death

Question/Comment: (the passing of brother Zakaria – may Allah bless him and his family Ameen} in our community has caused my family/myself to ask certain questions) I was wondering what my family should do in case of a death in the family ….. Being a small family here and not having a big community to rely on. I am afraid we won’t know what to do. I was wondering if we need to pay in order to register for the Muslim cemetery. Please let me know ….. so it is distressing at times to be thinking of such events. But Allah (SWT) has warned us that no one would know in which land he/she will die. (Please advice) (Sent to private email to the Imaam. It is shared to the public for the benefit of the majority. May Allah reward the sister for her email.)

Q. Does Islam allow burial insurance (brother Ogden)

Q. How can I ensure an Islamic burial?

Answer to the above questions:

  • As Muslims in America we face multiple challengers. A believer tries very hard to be good to the rules of religion and themselves whilst alive. A true believer also makes necessary preparations for death in a way that would make things easy for themselves and others. We are called upon to make dua that our life and death are both a blessing and not a burden to humanity. Your question shows sensitivity to such an Islamic idea.
  • Not knowing where we are to pass away makes matters challenging. At the same time, we become strong within our Imaan.  As Muslims we do not succumbed to burial insurance, etc. as a loophole to give us a false perception of security. However, as Muslims we do have several options.

* Buy a burial plot at a Muslim cemetery. The spot would be yours awaiting your arrival.

* For those that may be limited on funds — they should set aside money in a personal burial account to take care of burial expenses, and those associated with it. The reward for doing this would be tremendous. As one is aware, dying in United States is far from cheap. Cost to exceed $5000 is not unusual in certain major metropolitan cities. Utah costs remain in excess of $3000 (these are mere estimates, please do not send the Imaam your bill should it exceed any of these aforementioned amounts!)

*For larger families, each family member places $20 to $50 in personal burial account. Should a close member pass away, the others tap into their resources and help out. Burden and stress of each person is minimized.

*It is the duty of fellow Muslims to help out Muslims at the time of need. More so at the time of passing away. We should inquire if we can aid with bill paying. A grieving family’s dua would come to aid the giver, insha-Allah.

*Always have contact details in case of emergency upon your physical person. Your religion must also be mentioned on this card. Your local Islamic burial society’s up to date contact details. If married to a non-Muslim (not encouraged for men, a major no-no for woman) make sure you have a bequest that stipulates how you would like to be buried. Neglectful persons have had their Muslim spouses buried according to kuffar methods, causing torment for all. If living with non-Muslims, make sure a bequest exists stipulating the choice and place of burial. Recent cases have caused Muslims to be cremated (set to fire) due to ill social choices resulting in matters beyond the deceased persons control – due to lack of appropriate planning. Let us not become the next victim.

May Allah give us all prosperous healthy lives, Ameen.

Allah Certainly Knows Best.

(If people know persons that have passed away, and care to share their local (USA) experience, we would really appreciate it)

differance between tawba and istigfaar

Comment/Question: How does someone express tawbah and istighfar without falling into depression?

Comment by mm — June 11, 2009

Answer: For our student based audience:  many assume that tawba and istigfar are the same thing. First let us give you the distinguishing factors between the both.

Imaam nawawi states the regarding tawba (repentance):

  • tawba must be sort and remains wajib (necessary) for every sin committed. Example, read salaah late, did not give zakat on time; the wretched act of adultery was committed, etc.
  • Sinner must intend to uproot that wrongful action from their lives and makes a firm intention to never repeat the sin again
  • Regrets the evil committed. Rectifies ill habits by seeking forgive to Allah and those s/he had hurt
  • Naturally, if sin is committed again, the person goes through the same process, however, with greater levels of remorse until adverse behavior is eliminated Continue Reading →

KHALIL AL-KHUSRI and ABDULBASIT ABDUSSSAMAD

Question:
Assalamu alaikum. please i want to know the history of KHALIL AL-KHUSRI and ABDULBASIT ABDUSSSAMAD

Time Sent: Thursday June 11, 2009 at 2:39 am

Q. Can you tell me something about sheik Husary his reading method. I ask as follow up to you r topic on maqam

Answer: Both were amongst the best Qurra to have emerged from the Egypt. Both were renowned for the qirat linked to precision is observing the rules of tajweed. The former was also a practicing specialist and more renounced for hardar and tarteel mode of recitation (a pace which is not too fast and yet not necessarily extremely slow.) ) His tune is simple yet remains greatly tranquil due to its obvious sincerity. His recital style brings forth inflections which is superbly reflective of his supreme tajweed skills and mastery of it.

The latter had been more famous for his qirat recital and lived more within the modern era (up to the 1990’s). He also has recordings of slower recital of the entire quran as well.

As agreed by many in modern times, Qirat supreme would remain Shiek Abdul Basit, whilst Sheik kalil Al-khusri and his student sheik Manshawe paved the way for their mastery in the aspect of tarteel and hardar.

All should be listened without prejudice. They all inspired millions to excel in their recitals.

May Allah (Subhanahu Wata’Ala) shower his blessing upon them for the legacy they have left behind.

Again, we are not a historical site, but we are always happy to help out wherever we can. We hope we shared insight for those seeking to emulate patterns of these great men.

??? ????? ???????????? ???????????

Question: Assalamu Alaykum rahmutullahi wabarakatu,

So I was reading the tafsir of Surah An-Nas and on the 4th ayat “From the evil of the whispers who withdraws”

From what I read basically is it saying that the shaytan whispers evil in us at any moment, but when we remember Allah (swt) it withdraws, correct?
but where the confusion comes in is that I heard shaytan attacks us even more when we remember Allah (swt) like distracting us from prayer, reading quran, and doing good deeds; like taking two steps forward shaytan tries to push us four steps back.
If my first thought is correct then could you please elaborate more on it, but if its not then could you explain exactly when the shaytan withdraws, and for how long exactly does it withdrawal?
I’m sorry that is like four questions in one, but your answer is very much needed!

jazakallahu khair

Answer: و عليكم السلام و رحمة الله و بركاته

Regarding the phrase, ??? ????? ???????????? ???????????

The following points must be observed:

Maximized meaning derived for this phrase in question are best understood in examining the context and ayaat which precede and antecede it.

Workings of shaytan:

Three times prior to coming to the ayah of ??? ????? ???????????? ???????????, Allah (Subhanahu Wata’Ala) places an attack on shaytan. Allamah Qurtubi outlines that the word ???????????? (wasawas) refers to not just a whisper, rather a breath like occurrence that is finer than a whisper that is shared between shaytan and his intended target. It is passionate gesture, so much so that the recipient of the message feels as if he has become one with the evil attempts of shaytan and thus sometimes act accordingly. This passionate whisper is placed into the heart/mind of a person to the extent of it having the affect of polluting remote positive thoughts a person may have of  Allah and His Commands.

Allah(Subhanahu Wata’Ala) is making a significant point to us: shaytan does not avail himself in a transparent manner at all times regarding his deviant plots against the believer.  As we do good, shaytan breathes his whisper into a believers heart. Sometimes it is manifested in the people we meet, books we read, ideas that fester and let cultivate within ourselves and families, emails we send out, etc. Continue Reading →

can i pay more and him less for same floor space?

Q.As you are aware iam sure that the economic changes calls for businesses to make new decisions. To keep certain business to keep paying rent, rents have gone down for certain businesses, whilst others are to pay higher amounts.

What is the sharias opinion when the one leasing a building is told that if a grocery store rents it, the rent is $5000 whilst a watch keeper pays $2500.  Is this not discrimination? is this fair in islam? All parties are Muslims.

A. Such a transaction is correct according to the book of fiqh. The one renting need only pay the amount stipulated according to the contractual agreement. One can be charged in relation to the trade they are part of. This is not discrimination. Should one find that they are unfairly charged, they should go to a place that can better accommodate their wishers.

  1. Islam, like all traditional religions does not allow secret dating or the concept of ‘boyfriends’ and ‘girlfriends’ as you have outlined. Any relationship built  upon the justification of haraam (or an evil action) cannot ever gain its true necessary success.  This ‘boyfriend’ already knows this, due to him quoting hadith and Quran to his haraam mate! How more can a person insult Quran and hadith! Can a person eat pork whilst having the luxury of other foods while claiming that the Quran does allow for its consumption under extreme moments of starvation! You and your friend need to evaluate the type of people you hang around with. Allah (Subhanahu Wata’Ala)states: stay in the company of those that are obedient and truthful to Allah and his Messenger (SAW)
  2. Women traditionally suffer more from such hasty or ill founded decision making process then men. Woman from reputable families minimize their success of good marital propositions once they have embarked upon on such a slippery slope. As the Hadith states: Truth (and a lifestyle linked to it) brings contentment to the heart, deception destroys a person. (Hadith) Living a life fulfilling ones lusts is a life of falsity, and it should be abstained. Pursuing a man/woman without parental consent is linked more to lust and disobedience then religion.
  3. People that take part in secret marriages — although at first it seems like the right thing to do, over a period of time such persons accept their wrongful choices. This is either out of guilt, shame, emotional blackmail, or as a result of committed actions that surface which limits future interpersonal success. Shaytan knowing that you are vulnerable, toys with the mind by saying: you are doomed, no one is ever going to accept you, not even Allah (Subhanahu Wata’Ala.) (based on ayah) Allah (Subhanahu Wata’Ala) states:  shaytan beautifies to wrong doers their wrongful deeds. Once they are placed in the midst of a quagmire, shaytan flees leaving them in an embroiled dilemma.
  4. If she is going to inform her family, it would be a major violation of trust to do so after 5 years. It is best to deal with the matter now then later. All major fuqaha agree: such a secret marriage would be reprehensible. It is worthy of the anger of Allah (Subhanahu Wata’Ala). The emotional state of the couple would be a reflection of this. Allah (Subhanahu Wata’Ala) loves calmness, when we violate His commands, calmness goes away from our lives. (Derived from quran.)
  5. People that get tasks accomplished by manipulating sharia never find barakah in their deeds. Never be like shaytan and justify actions that would divide a family. It is best for him to state: My desires are the overriding factor of my wanting marriage to occur.  A person not qualified in the area of sharia has no license to quote and interpret, more so, when s/he is unaware of the all the data and implications of a given quotation and its interpretation. We should stay aloof from such deviant persons, more so when they impose their given data as absolute to fulfill a personal adgenda. Such data sharing is a conflict of interest.
  6. The only condition for a secret marriage would be that they are about to commit adultery. Such does not seem to be the case. Even under such conditions it remains a reprehensible act, for one must not place themselves in such a situation. (Hadith – from the books of usool as linked to hadith, etc)
  7. Once married, if in secret, your friend must realize that nothing prevents him from walking out, she would be stuck in the relationship once her honor has been lost. She opens herself to many abuses and accusations. Any person that wants to break the laws of Allah cannot be trusted with rules of compassion towards humanity. We must insist of staying away from the Agents of shaytan.
  8. All major imaams agree that such marriage is a mockery of sharia, unless exceptional circumstances surround it. Seethe following three articles by us.

Allah Certainly Knows Best.

p.s. It is out of kindness that we are giving you hadith and ayats as proof. Proof need not be given to people that are limited in their knowledge of Arabic and its link to methods of deriving laws from Quran, Hadith and Sunnah, etc.  It is nice to request such data, but it is of little use to the average person. Seldom do we see doctors teaching people on the street about the proofs of hearth or brain surgery. Other then entertainment, such data sharing functions for little benifit. May Allah (Subhanahu Wata’Ala) help your friend make a decision that would her stand proud of herself, her family – present and future.

p.ss. please have the brother send us his set of proofs that allows him to go forth with such a marriage.

heart loves, mind rebellious

Q. Dear Brother/Sister in Islam,

Asalamu alaykum!

I am a muslim convert for 2 years now. I got married and now my husband is divorcing me because he like to marry another lady and he cannot afford to provide financially for 2 wives. I believe that I had given all my best to be a good wife to him. Even I’m not born as a muslim, I was clean when he got me as his wife. I’m his first wife and he is my first husband.

I feel so bad about his reasons. It doesn’t make sense at all. I tried still to win him back, but I already reach the point of making myself so low, begging for him to stay with me still.

My heart loves him so much, but my mind is now getting rebellious. I just want now to let go but at the same time I want to know what rights I have because we dont have children.

Please advise me as soon as possible. Thank you and Allah Hafiz!

Sincerely,

xxx (name withheld)

A. ?????? ?????? ????? ???? ???????

May Allah accept your conversation to Islam. May you be rewarded for all your challengers, Ameen.

Although you feel that there is no need for a divorce, sometimes it is best to accept our given situation, then lament about it, or live in denial as to focus only on the positive past aspects of the relationship. It would be preferred for you to find someone that would appreciate you then live with a person that possibly resents you. This is neither fair nor healthy to either party or parties that are close to the both of you.

Begging people can make matters worse. Begging a spouse could make a spouse resent you. For some, forcing persons to be in a relationship could have an adverse affect, more so, when they are seeking to exit the given marital domain.

As we have stated previously: ‘You are not required to endure any type of anxiety or patience if the man you are with possesses loose morals in the form of having relationships with others that Islam prohibits. Compatibility in marriage is essential. It is built on trust and following the commands that both parties believe in. Marital partners that are not compatible, result in a relationship filled with unwanted conflicts and higher levels of marital uncertainty and dissatisfaction. It is best you walk out now than suffer the unbearable grief and agony of divorce upon having a family with children.  Although we don’t encourage divorce, sometimes its best to cut your losses and walk away when you feel you cannot do justice to the rights of another.’

Your rights are the ones Islam gives you. Some of them are as follows: not marry another if the country allows for multiple marriages and an agreement existed between the both of you prior to your marriage. Once divorced, he must get you back to your parents home under safe conditions once the divorce has occurred,  make arrangements to pay of monies he owes you, expenditure linked towards your  iddat period unless you forgo it, you must complete your Idaat, for a pregnant woman, her iddat would end upon birth of child, etc. These basic rules can be outlined to you by your local scholar as well.

More importantly, I would request you to do some soul searching with the following in mind: why would a man truly divorce a person that claims to be as innocent as you purport? To us this makes little sense. But then, it takes all types to live with in this world.

Allah Certainly Knows Best.

hacker

Q. Will it be justified, not for you to hack but getting another person to hack your fiance or spouses email or computer, to gather info on them possibly cheating or up to no good?

Comment by Anonymous — June 1, 2009

Q. Asslm Imam
We would like your help on clearing a debate we having. The {muslim} boys say it is ok to set up a web page, as a online muslim chat ,with the line to getting to know islam better.BUT it is not for that, it is to get IPN pc tracer, to hack email and pc of their, sisters, wife or future partner,to make sure they behaving. We had showed them your answer to a previous question you received. What answer do we give them now?
Wsslm.
p.s if you could answer as soon as possible would be much appreciated 🙂

Q. Is data received from hacking permissible in a sharia court?

Answer. If a thing is not permissible for you to do, then how could it ever be permissible for someone else to do?! Mere suspicion does not warrant criminal behavior. Islam is about doing good and helping others do good. Islam has NEVER advocated for us to be good, whilst having others do our dirty work! How about a tab bit of compassion towards fellow humans! Hacking is against the law. Muslims are to abide by the laws of their respective countries.  Seeking out an ‘IPN pc Tracer’ for the purposes as described by you degrades the high morals and values of Islam. Continue Reading →
