male versus female prayer

Q. Imaam shafee allows for woman to perform prayers no different from that of men. Imaam  Abu Hanefaa says that she cannot pray like men. Abu Hannefas method is like a woman that prays like a dog. Imaam shafee is like a human. Can you explain why? Is this a indo pak thing? Or am I wrong?

A. The accusation placed on Imaam shafee (kindly excuse us for occasionally saying Rahmatullullah Alay) is an insult to ones basic understanding of salaah, an accusation that has no basis and stems from sheer ignorqance. You are confusing the opinions of neo-salafees to that of Imaam Shafee. To our dismay, many counterfeit shafees also attest to this false assertion and place similar bogus claim(s) upon Imaam Shafee (Rahmatullullah Alay.)

The prayer of men and woman remains different, just as they are different in many other regards. Female salaah has little to do with emulating a dog, cat, rabbit or a mouse. Female salaah has to do with concealment in the aspects of her body and showing her inherent nature of modesty even whilst in salaah despite no person at times being able to view her in salaah.

Proof:

For example, even in the confinement of her home, a woman’s salaah gains greater virtue if she remains properly concealed. Allahmah bayhaqi states: The salaah of a woman is void unless she wears a head covering (proper concealment of her body). (Bayhaqi). Bayhaqi also stated:  The distinguishing factor between the rulings of salaah of men and woman is (the issue) of concealment. A woman is prescribed to do all actions (like men, however with an added dimension) which is additionally (to be)  concealing (of) herself. (Bayhaqi)

Hadith counters your ‘dog’ claim

On the dog emulation issue: Rasulullah (sallallaahu alayhi wa sallam) commanded men to not spread their arms on the ground like that of a dog (Imaam Muslim).  As for woman, Yazid bin Habib (RA) reports that Rasulullah (sallallaahu alayhi wa sallam) passed by two women who were performing their salat and he said to them: . He said to them: When you prostrate, make the parts of your body touch the ground for the reason that a woman is not like a man in such characteristics.

The real thruth about Imaam Shafee (RA)

In Al-Umm, Imaan Shafee (RA) reports that male and female prayers are identical expect for the fact that a woman is to be more concealed in the aspects of ruku and sujood. Thus her ruku is not like that of a man, in that she slowly bows down and places her hands on her knees, in a none man like grasping manner. Her sujood is not stretched out like her male counterpart either. This is the opinion of other fuqaha as well. Imaams Hambal and Haneefae.

Abdullah Ibn Umar (RA) (as can be viewed in Jami’ al-Masanid) it is reported that Rasulullah (sallallaahu alayhi wa sallam) ordered woman to draw themselves closer together and lean onto one side by merely resting on their left buttock whilst completely contracting themselves.

What is the origin of these predecessors that agree with us!

Sahaba and other eminent scholars within the ranks of mujtahids  have also contributed to the above. They include: Sayidinah(s) Ali, Umaar, Ibraheem Nakaee, Ibn Abbas, Hasan al Basi, Yazid bin Habib (RA), etc.  Hadith supporting such facts are found in the works of Bukari, Muslim, Bayhaqi, Abu Dawood, Musannif Abul Razaq and ibn Abi Shayba, etc. (As can be astutely observed, none of these persons are of indopak origin. We stand to be corrected with your power points of wisdom, should we be in error regarding their origin — should it matter when it comes to facts representing sunnah!)

We got no gripe with your salaah, so let us pray and take your fuss elsewhere

Although salaah goes through for both methods. Persons choosing wrongful analogies should not impose their whimsical methodologies on concrete data. They should also minimize their vilification of innocent mujtahids. Corrupted ideas and pursuits lacking depth should be avoided – be it intentional or otherwise.

and you got time for games!

Q. My friend (close) and i buy and sell things together. The agreement is as that the seller of the item gets 70% and the reminder 30% goes to the other person. Sometimes I sell the item, sometimes my partner sells it. Is this fair or is a partnership limited to 50-50 between two persons? Ex: seller sells the game for $300. Cost is $100. Out of the $100, 50% is mine, and 50% is hers. Seller keeps $210….

A. To do the above is correct.

(Better if you did not deal in games, unless you both promoting added learning for students, etc…)

A1. If it is proven that a wife if innocent, then she must be defended. To not defend the honor of any person when one has the ability to do so is cowardly. It is against the grain of commanding good, and prohibiting evil. (Ayah)

A2. It would depend on the agreement between the spouses. Rights can be negotiated, a woman can be awarded greater right just as she can relinquish part of her rights.

A3. A man and woman should not be separated without a valid reason. More so if there is a possibility of adultery, etc.  There separation would depend upon their given agreement. (also see A.2)

A4. If she is alone, should emergency arise, she must be able to contact him or those appointed to fulfill her halaal emergencies/requests. This substitute could include her family,  her in-laws or an appointed appropriate guardian.

A5. He is in conflict with the quran. One cannot command well and do its opposite. (ayah) This is the trait of a munafiq. (derived from quran and hadith) May Allah (SWT) guide us all, and save us from such disrepute, Ameen.

A6. For a man to deny his wife the position of marriage under normal voluntary condition  negates the nikah if he has intended it as such. If he said she is not his wife and meant it with the intent of divorce, then they are divorced! If he did not mean divorce, then the marriage remains intact. (we are not opposing western law, the matter in a western court would be different.)

A7. He is violating his rights towards her. He is worthy of blame in the case of not having a valid reason.

A8. (You missed number 8 and went to number nine! At this point, we are forced to state: a person not knowing how to count calls for us to make a disclaimer: ‘the answers are only to the questions posed. It is not placing blame on either of the spouses. We hope it was a mere lapse and nothing more.)

A9. If it is proven that he is a liar. That makes him a possible fasiq (transgressor) and fajir (criminal if proven as such). His testimony would lose credibility in the sight of Muslims on certain Religious matters.

A10. He is committing the most wretched act in the Eyes of Allah (Subhanahu Wata’Ala).

A11. Yes. But an abhorrent action is indeed being committed.

A12. See 11 and 12

beard and female resistance

Q.) Aasalamualaykum
Moulana, what is the right length for the beard? Can my fiancé family on her behalf ask me not to keep one? When I went with my family to meet, I had one, and my beard (it is kept neat and tidy about a fist lengh) was not a problem at that time, she feels that I would be missing out on greater job promotions with my beard. I really honestly not happy with her request. Advice please on how to approach the family in refusing such a request. Jazakumulah. Faheem.

Q.) A young person I know keeps a beard to be viewed as pious but he trims it without validity to less then his fist length sighting diff of opinon. is diff or opinion a valid excuse? Does his beard count as a beard?

A.1) (http://islaminaction.wordpress.com/2008/12/24/debating-the-beard)

A.2) A hunch-(feeling) is not proof enough for a better job prospect. Such arguments are from shaytan and his cronies. They live on guess work, true Muslims live on facts derived from Quran and sunnah. Sometimes a lower paying employment gives greater barakat then a higher paying job. Muslims seek barakah in all they do. One way to accomplish this is through obedience and compliance to Allah and His belovered.

A.3) One cannot obey the creation in exchange of the Creator

(?? ???? ?????? ?? ????? ?????? )

Don’t do what you not comfortable doing. If you man enough to get married, you should be man enough to make your own halal decisions! (This rule is for men and woman!)

A.4) Be with the pious (ayah) Do not volunteer to be around people that insist and wish for you to assist in the prevention of that which is likened by sunnah. Regardless of how convincing they may be. They are restricting you from the pathway of sunnah, the quran curses such people (ayah). Instead, be with ones the Quran praises.

A.5) Islam is not fashion oriented in its dress code, more-so when it does not represent the sunnah. Keeping goatees and other fantasy or fancy fulfillment facial features would not qualify for a sharia compliant beard. (Just as wearing a scarf that intentionally exposes much of a woman’s hair is not really wearing anything on the head!) Although we should not dictate the above to anyone in a country of choice, we can cordially advice the wise.

{A.6) There are circumstances that allow for trimming of the beard, your query does not necessitate such measures}

silk worms working overtime

Q. Asalamu alaykum,

Dream1) I was wearing the most beautiful silk garments in my dream. Does this mean I would be getting married? I would be rich?

Q. Dream 2) I also saw corn and some grain used for cereal. To me this was strange. The grain was pale when I saw it. I researched and found out that such grain is also used for flour. Does it really have a meaning. I am not a farmer and not live close to a farm.

prophets and the unseen

Q. Do prophets have the ability to know the unseen ( that which is most hidden/concealed) Can anyone prophet really know the future? (personal email)

Answer:

?? ??? ??????? ???????? ????? ?????? ??? ???? ?? ???? ????? ?? ???? ???? ?????? ??? ?????? ??? ?? ????? ????? ??????? … (???????)

The knowledge of the unseen is matter specific to Allah alone. No individual can attain such knowledge except if Allah conveys (that given knowledge to ) the person from His Side or via Ilham (special insight) in the manner of a mirical (as achieved by prophets)… (al-Nibras)

Allah (SWT) had given secret and private information to Prophets (peace be upon them all) for the reformation and benefit of fulling His task on earth. To deny this in its absolute manner would be tantamount to kuffar (disbelief).

Its not just a woman killed, it is ‘Muslim woman’ killed…

Woman killed in courtroom — bloodbath — pregnant

A (Muslim) woman stabbed to death in a Dresden courtroom was three months pregnant, reported German newspaper Bild on Friday.

According to Egyptian newspapers, the woman was Marwa al-Sherbini, a 32-year-old Egyptian national who was suing her attacker after he insulted her for wearing the Islamic headscarf. The attacker, identified only as Alex W., was appealing the €780 fine he was ordered to pay in the libel suit. Continue Reading →

Shaban: moderate path between overzealous caution and extreme innovation

Q. what does  “Shabaan” mean? (is it a name or a month?)

A: It is the month before Ramdhan, linguistically it means “to appear” or when “the Arab tribes would disperse for water resources”.  However I like to use this linguistic meaning that one hadith emanates

The hadith is in Musnad Imam Ahmed, Vol 6, P261

Hazrat Usama bin Zaid narrates in a long hadith (only the relevant portion mentioned here) “That month a lot of people are oblivious about between Rajab and Ramadhan, it is a month in which the deeds Ascend (are sent) to Allah, So I like that my deeds Ascend (are sent) while I am fasting” correct chain of narration ???????? ?? ?????

Linguistically it would not be incorrect to also use the meaning of the word “ShaAba” (one degree of Shaban)

Like the Arabs say “ShaAba” in the meaning of sending.  Hence linguistically we can derive another meaning of the word “Shaban”

A month in which Deeds Ascend (or are sent) to Allah.  This meaning is strengthened by the hadith as well.

“in the night of the 15th of Shaban Allah gazes upon all his creation and forgives all his creation except a Polytheist and the one who is Mushahin (Grudge filled individual).

According to Ibn Rajab Imam Al Awzai says “Mushahin means the one who has ill feelings towards the Prophets Sahaba (companions)” or an innovative person.

And Ibn Thawban says” The one who spills the blood of this Ummah”.

Q: is there any other unique feature of this 15th of Shaban night?

The Prophet (SAW) says: “Allah descends (how only Allah knows but we submit and believe and ask no morphological question on how) on the night of 15th of Shaban to Sky of this World, He forgives everything (notice everything not everyone, how gracious is Allah!) except a Human who is a polytheist and a grudge filled person.”

This hadith is in Ibn Khuzayma’s Book of Tauhid under what is termed as the “Chapter of the News that is Authentic.” Hence in the beginning of this chapter he designates it Sahih.

Prenuptial agreement

Q.

asalamu alaykum,
I was wondering can a man ask for prenup in his nikah?
or is there a amount he must give?

Time Sent: Saturday July 11, 2009 at 7:19 pm

?????? ?????? ????? ???? ???????

  1. Prenuptial agreement is loosely defined as a person stipulating that at the time of divorce (or death), X is willing to give Y a specified amount of wealth; or it could mean, x with depart with their possessions, and y would do likewise — not owing anything to the other. (This is the general simplistic concept of a prenuptial agreement.)
  2. Islam does not accept the concept of prenuptial agreements that are in conflict with its Islamic interests, since each party has the right to depart with what remains theirs at the time of divorce anyway.
  3. A man must pay for his wife’s expenditure until the end of the Idaah (waiting period) unless agreed otherwise by a sharia bound agreed process.
  4. Should a party articulate that each party departs the relationship with what belongs to them with the added clause that a man would pay for the expenditure of the iddat period, as well as a fair amount which is judged by a reputable set of Muslim scholars — then such a prenuptial agreement would not be in violation of Islam protocols. Also if the man stated that he would pay fair child support for the rearing of the child should he chose to leave the child in her custody — more so as a result of child’s infancy, vulnerability, or him choosing to abandon his rights and responsibilities towards the child etc., then this child support must not be imposed by a disbeliever, but by mutual religious concerned party through methods of fairness and justice for the best interest of the child.
  5. Both parties can request a prenuptial which is also sharia bound, should it be viewed that Islamic laws would not be adhered to at time of marriage/divorce.
  6. (All Islamic marriages are technically part of prenuptial agreement)

marry now, take out later (cultural torture for some)

Asalamualikom,

In some cultures they first do an engagement and then a year or 2 later do marriage. People in my family always do Nikah during the engagement time along with always a third party there if the two couples were to see one another. I know once nikah is done they are literally married, but they still wait till the whole process of “wedding” is done. (Comment box)

Answer: (Response)

*now this is what some call, ‘halaal dating!’

Key facts: as you have described, it seems like in your ‘family,’  the men/woman are married at the time of engagement. Seemingly the marriage during this time remains a time for the boy/girl to better understand each another.

Only complication we have seen in the above is as  follows: boy/girl never takes part in shared intimacy because (sometimes) parents place a strict and well imposed and highly secured limitations; to stop a married couple from halaal actions is haram. If you don’t trust them, then don’t get them married!  (This is what those surrounded by the issue tell us.) Adult activities only take place once girl/boy has attained USA greencard/passport. This manipulation in islam is wrong.

Only positive that sometimes results during this so called engagement (which is really marriage) is that when the boy/girl feels they don’t like each another they can each move on. Issue gets complicated when one party refuses to move on, more so when the male refuses to take the hint of talaq…

Statistically, the marriage you have described remain within a particular family or close net work/culture. To such persons is also the motto: until death do we part!  Such is viewed as an infringement by westernized Muslims.

The ‘process of the wedding’ as you have termed it in reality is not really a wedding; it is a mere farewell, or a belated wedding party to show acceptance (of many months/years of awating or the celebration of ones endurance to personal torture or patience)….
