Q: if a wife gives the mahr back to her husband on asking him that he”ll return it back…is that mahr completed or done. should husband return that mahr back to her wife (when she asks back for it)…..?

A: Your query appears ambiguous. As a result, we may appear to answer a little extra.
- A woman can give her mehr back to her husband. A husband should try to not take it back. Ibn Abbas (RA) reported that Rasulullah (SAW) said: One who gets back the gift is like one who eats vomit.
- It appears that the wife attempted to keep her mehr as an amaanah (entrusting.) Should this be the case, he must return the mehr upon her request.
- The mehr is completed when he gave her the promised amount. His liability is hereby absolved.
- If a wife receives $5000. Later she wishers to give her husband a $5000 gift, she may do so as well. It would be best that he took the $5000 under a different jinx (a way other than that which he gave the mehr.) Example, one gave $5000, the other gave gold/silver, etc of such value.
- Any woman giving her mehr back should try and do so in writing with (the original) witnesses present, if possible.
Under usual circumstances, woman do not just give back their mehr or gifts. They only do so under oppression or extreme piety. Generally, in today’s time, its as a result of abuse. May Allah (SWT) protect our woman folks, ameen.
