My father skipped both of us… we don’t have all the facts…

Q: My father skipped both of us brother in giving us our inheritance. He gave equally to our kids.  He did this 5 years before he died. The amount was about 5 million euro plus.  We want to know if we have any recourse at all. Can you help us both. Jazakumullah

A: To your father belonged his wealth. He can dispose of it as he chooses during his lifetime. He can skip you and your brother so long as it was done to reduce harm, not increase harm upon the both of you. For example, if you and your brother are known gambles or drug uses, giving such wealth to you and him would be in vain, thus, in such an instance your father could have skipped the both of you and distributed his wealth in his lifetime (while alive) to your children (aka his grandchildren). Likewise, if you father had fulfilled your wants, in such an instance he could also give to your kids as a gift while alive.

Additionally, since they are your children, if you raised them well, they should have no problem sharing their wealth with you.  It is the right of a child to take care of a parent that is in need of assistance, more so in a situation when a child is blessed with wealth.
