Q: Ya imaam we would like to know what is khiyarul maglis (choice of a transaction as related to a specific gathering) How does Imaan Shafee define it? We are both shafees. Can 1 buy the product later or i can never walk back to that store and product we disagreed on? Can some1else buy that product?Time: Friday March 26, 2010 at 10:19 am

A: The term you have requested information about deals with a situation wherein a buyer and seller are about to buy a product that is generally in front of them. (Not like a special door that has to be ordered or made with particular specification.)

Buyer and seller have the choice of nullifying the agreement of purchase prior to parting company, or both or either party can state that they do not want to pursue the sale beyond the current moment. Parties stating that they wish to end this given agreement would terminate the pursuing of the article at that given moment.

A new contract for that article can be set at another time. This option to cancel even though parties are about to agree is an option that remains for parties on every sale. This option continues for the duration of the sale and the ownership of the article would remain suspended as well.

Allah Certainly Knows Best.
