‘I give you Talaq’

Q:  imaam saab, yesterday at (event/venue name removed) an imaam said that if I said talaq one time to my wife our nikah is over. I did say talaq once in my life. After saying it I took her back immediately in my nikah with her.  My exact words were I give you talaq. Now this imaam who is not a mufti is making me go crazy and ruining my family. He said we are talaqed can you give me a written answer please. Does it matter if a person has children and grandchildren? And does not want to break up the family unit?

A: ‘I give you Talaq’ is viewed as a Talaq-e-Rajee. In the case of a Talaq-e-Rajee, the husband taking her back during the iddah period would be permissible.  If the husband did not take her back during the iddah period, the nikah would be viewed as terminated and a new nikah would have to take place. (Kindly view Radul Muhktaar. See volume ten page 500)

Allah Certainly Knows Best.

p.s. It is not that the imaam is ruining your life. I do not know what you asked him and what you really heard from him. Be cautious as to your utterances. May Allah (SWT) bless your marriage.
