divorce via text! if you get the text, its over!

Q:my husband sent me a divorce with the text that said when you receive this text you are divorced from me forever. My phone was dead (battery). When he called me at work and told me that he sent me a text did I get it I answered no. He said go and see it. My phone was shut off because battery died. I have never put my phone on since. My question is that since he used the words of talaq am I talaqed? This was explained to me by my husband later on that he sent me a text with the above information. He never wanted to divorce me he later said (email)

A:  There was a condition to this talaq. Since your phone was off and you did not receive this text, the talaq would be ineffective. However, if and when you do decide to turn on the phone and the message comes through, this talaq would become effective.

If you did not want this talaq, kindly disconnect your service to ensure that this given message would not come through.
