Can I have a non-Muslim for a Mahram?

Q. Can a mahram be kaffir ? Can I go for hajj with such a mahram?

A. The majority of scholars state that a mahram can be a kaffir. Being a Muslim is not a condition for being a mahram.

Under general conditions, you would not be allowed to go for Hajj with a disbeliever. However, you would be allowed to attend other permissible places with this mahram.

Surely this mahram would not be your husband, for a Muslimah cannot marry a disbeliever. We are hoping he is your son, nephew or someone you cannot Islamically marry upon his conversion to Islam.
