Traveling Alone?

Q. Is it permissible for a Muslim female to travel alone for educational or work purposes, if she doesn’t have any mehrem.

Q. Under what conditions can a woman travel alone?

Answer: Kindly Observe the following ahaadith:

Sayyidina Abu Huraira (radiAllaahu anh): Rasulullah (sallallaahu alayhi wa sallam) said, ‘It is not permissible for a woman who believes in Allah and the Last Day to travel for one day and night except with a Mahram.’

[Volume 2, book 20, number 194, Imaam Bukhari]

Sayyidina Ibn ‘Umar (radiAllaahu anh) reports that Rasulullah (sallallaahu alayhi wa sallam)said, ‘A woman should not travel for more than three days except with a Dhi-Mahram (a male with whom she cannot marry at all, e.g. her brother, father, grandfather, her own husband etc.)’

[Volume 2, Book 20 number 193 Imaam Bukhari]

Sayyidina Ibn Abbas (radiAllaahu anh) narrates that that he heard Rasulullah (sallallaahu alayhi wa sallam) saying, ‘It is not permissible for a man to be alone with a woman, and no lady should travel except with a Mahram.’ Then a man got up and said, ‘O Messenger of Allah (sallallaahu alayhi wa sallam) I have enlisted in the army for such-and-such battle and my wife is proceeding for Hajj.’ Allah’s Apostle said, “Go, and perform the Hajj with your wife.”

[Volume 4, Book 52, Number 250 Imaam Bukhari]

Thus, based on the above ahadith, approved consensus by the uluma have made it such that woman should not be alone beyond the distance of 48 miles. This would prevent her from been tempted to do wrong, prevents her from being wrongly accused, prevents her from being viewed as an ‘unchaste woman,’ eliminates or minimizes the possibility of her being harassed, etc. Religion has outlined prescriptions that are beneficial for us; we are unaware of its positive impact. It is only later in life that we appreciate its benefit.

Exceptional circumstances:

Under the principle of zarurah (extreme exigency) a non-permissible element (component, etc) can be made permissible. For example, she would have to prove that no one exists to support her, she is under traumatic conditions and is forced to reside away from her parents, she have to articulate abuse, show she has no caring brothers, lacks a caring and responsible uncle(s), etc. Thus, modern day scholars, with serious reservation have given an allowance of traveling without a Mahram under the aforementioned conditions.

Naturally, her first choice should be to reside in her home land to fulfill her halaal requirements. Should this prove difficult, traveling to strange land would be made permissible. In the process of such travel, she would be utilizing the rulings of Imaams Malik and Shafe’e. She would depart on the journey with a group of woman using extreme precaution and modesty; she should try and never be alone during the cause of travel. Stay with other Muslimahs at all times.

The only educational purpose she can travel for would be to again Islamic knowledge. This too should be undertaken with a group of woman. The imparting of knowledge upon her should be done in an islamiclly religious environment wherein men cannot prey upon her.

Can I have a non-Muslim for a Mahram?

Q. Can a mahram be kaffir ? Can I go for hajj with such a mahram?

A. The majority of scholars state that a mahram can be a kaffir. Being a Muslim is not a condition for being a mahram.

Under general conditions, you would not be allowed to go for Hajj with a disbeliever. However, you would be allowed to attend other permissible places with this mahram.

Surely this mahram would not be your husband, for a Muslimah cannot marry a disbeliever. We are hoping he is your son, nephew or someone you cannot Islamically marry upon his conversion to Islam.

I have no mahram

Q. If a woman cannot stay with her brother in law, and I have no other mahram, would I or could stay in a dorm? Since I have no person at all. In such a situation what would be best for me to do?

Answer: An all female dormitory would be preferred in such a situation. If possible, stay with other Muslimahs.

This is not recommended Islamic practice, but if this is the choices we are to choose form, then such would be our answer.

Residing with brother-in-law?

Q. Can a woman reside with her brother in law while her sister goes on a long distance trip?

Answer: Rasulullah (sallallaahu alayhi wa sallam) stated: “Brother in law is death.”  Based on the correct meaning of this Hadith, it would be a sin to travel alone with him. Sayyidinah Uqba b. Amir reported Rasulullah (sallallaahu alayhi wa sallam) stated: Beware of getting into the houses and meeting women (in seclusion). A person from the Ansar inquired: (Oh) Rasulullah (sallallaahu alayhi wa sallam), what about husband’s brother, (what can you inform me regarding him, what should our relationship be like towards each other,) whereupon Rasulullah (sallallaahu alayhi wa sallam) said: The husband’s brother is like death.  (Book 26, Number 5400, Imaam Muslim.) The word husband’s brother refers to all brother-in-law and sister-in-law situations alike.

Female as mahram?

Q. Can I as a female stay in a dorm? I cannot concentrate at home. I would be staying with my friend. Can she be my mahram?

Answer: Your friend (or blood sister) cannot be your mahram. It is against the protocols of religion. More so when it is known that you have a home and mahrams are willing to take care of you in a responsible manner.

Your solution would be to create an environment within your home to study. Or go to a local library to help yourself keep focused. It is best to be with a mahram so as to avoid any type of disgraceful actions. Never be alone with a male, be in a publicly visible area so as to avoid being tempted to that which is forbidden. Never allow yourself to be seated alone with a strange man.

The dormitory would not be a solution for your studies. It generally would compound to other problems. It would be best to stay away from such an environment whenever possible.

Request for participation

Assalaamu’Alaikum wa Rahmatullaahi wa Barakatuhu.

It’s been brought to our attention that there are a few issues regarding marriage and women that need to be addressed. The Islam in Action website would like to produce a series of articles discussing the issues that were raised recently. In order to do so, we would like to have the participation of women who are facing cultural issues which clash with their Islamic understanding. Any woman in the Salt Lake City area who would be willing to answer a few of our questions so that we can we establish root causes and effects is invited to contact a responsible, qualified sister who will maintain confidentiality and hopes to deal with compassion for all involved: sisters, as well as parents.

We would like to address this with an academic and Islamically appropriate analysis on the role of culture in marriage in America. Interested parties, please see and contact the MSA Vice President at the U* who will forward us your details.

Looking forward to a healthy dialogue, bi idzhnillah.

Wassalaam.

*Note to the MSA VP: Sister, please ensure that you know the sisters who contact you, even if you only met her in passing. JazakiAllah khair.

dont race the Imaam

Q. The imaam made sajda sahw. I stood up when he mae the salam. I did not make the sajdah sawh. Could I have made it in the end? Does the sajdah sawh apply to me for a mistake I did not make?

A. The Imaams sajdah sahw becomes binding on all those that are behind him. Since you did not do as you were commanded to do by the Imaam, you have voided your Salaah. Thus, repeat that given salaah again.

In future, wait for the Imaam to make a complete tasleem (salam to the right and left) before reading rakats you have missed.

Minors and birth control in Islam

Q. Can a minor be given birth control? Can a Muslim doctor ethically (under the rules of Islamic ethics) prescribe it to a minor? (one who is under 18) (Utah State  medical  student)

Answer:

If the minor is married according to the state and Islamic laws, and it would be legal to prescribe such medication, then it would be allowed.

If the minor is using such measures to regulate an aspect of her health and is prescribed by the doctor for such purposes, she would be allowed to use ‘birth control pills.’ This would apply so long as an alternative does not exist.

Under general circumstances, a woman should not be prescribed knowingly for the purposes of premarital relations. Should there be no adverse consequences for the Muslim doctors, doctors should hand such cases to  non-Muslim doctors.

sports and the muslim female

Q. I have a Muslim friend and she is a great athlete in physical education class (P.E) she is a really great player. She was chosen to play for a school game which was soccer but she said no. I asked her why she wouldn’t join in and she told me that her parents thinks its bad for girls to play sports. Does that contribute to her religion? I am really interested in Islam. She explained it to me but i was confused was her parents stopping her or her religion? Thank You very much..

A: We are thankful that you have directed your question to our religious department.

As good believers, we should praise our Creator for having bestowed upon us the ability to use good judgment on matters that reflect our satisfaction and contentment with the choice we have made to be part of a given faith. As Muslims, we are called upon to live a life of ‘righteousness’ and ‘modesty.’ Our good behavior should not be limited to our mere households, but should  prevail upon every domain.

Islam wants its citizens to present themselves in a manner that would show honor and dignity, healthy community relations and the true face of religion at all times. All traditional religions demand that we take part in activities that reflect such choices. As we are aware, amongst the negative attributes of modern sporting events is the requirement of a uniform code that maximizes the flagrant display of flesh and skin. For a man to intentionally display from navel to the knee would be incorrect; a woman should not show the shape of her figure to strangers from the neck to her ankles. As noted, modern sporting events thrive of neglecting such decency.

Woman partaking in sported activity should observe the following basic criteria:

· The sport activity would be inclusive of only woman

· She is not made into a public spectacle, in that, boys/men, non-Muslims can admire her, or portions of herself. After all in Islam, a woman is fully human, not a piece of meat to viewed by lustful eyes

· It must be proven that the sport she would be part of would continue to maintain her dignity on every level. There would be nothing forbidden taking place, nor would she contribute to any haram (forbidden actions)

· She would not be viewed by strangers via recordings, etc. If monies are to be derived from the event, it would be from avenues that are not linked to anything forbidden. E.g., alcohol, etc. Such monies would also be used as religion would demand, in a noble cause

· The sport is viewed as part of sunnah (tradition of the faith)

As would be noted, the above criteria maintains the highest of standards for believers of the faith. It would be advised that for health purposes, it is important to take part in exercise. This exercise should be done in a manner that would uphold every criterion of human dignity (self respect) whilst maintaining the protocols of religious tradition.

prayer within a prayer

Q. What are the duas between the two sajidas?

A. The following is mustahab and should be recited while sitting between the two sajdahs:

??????????? ??????? ???? ????????????? ??????????? ??????????? ????????????? ????????????? ????????????

O Allah forgive me, have mercy upon me, grant me ease in my well being , guide me (to the strainght part), grant me sustenance, mend my losses, and grant me a high position (in the hereafter, more then in this world).

Or one can merely just recite a portion of it with the following words:

??????????? ??????? ???? ????????????? ??????????? ??????????? ?????????????

O Allah forgive me, have mercy upon me, grant me ease in my well being, guide me (to the strainght part), grant me sustenance.

This dua can help one become independent and less needy upon people.
