so long as it is only talking you doing

Q. Can I talk to my husband before I marry him?

What questions are asked in marriage interview? Also can u tell me of do’s and donts?

A. With your appropriate Mahram present, yes, you would be allowed to communicate with your intended spouse. It is best that this communication be focused on achieving greater insight as to your intended. The conversation should not be mere chit chat.

no, you cannot see it all

Allah certainly knows Best.

For Adults Only: Get out of your cultural rut and live your life, not the life of others!

Q.
I was raised to believe that a persons deen/iman was more important then any thing else and I have stuck by that belief my parents have instilled in me. Recently I was proposed to and alhamdulillah Allah has answered my prayers because I truly feel lucky to have this person. Sadly we won’t be getting married for sometime and the reason for that is he doesn’t come from money (i.e. wealthy parents) but I do and because of that my mother expects him to throw a lavish wedding. Every time I try to talk to her about it she asks “is he marrying you or are you marrying him” the way she talks it’s as if he showed up at our door step pretending to be someone else but he was honest with her and told her he didn’t have much but would work hard. I as his witness know that he’s worked his behind off but with his current job what he’s making comes out to nothing after all his bills are paid, he’s going to school fulltime and so he cant work as much.

I want to marry him and I want to help pay for the wedding because according to my mother “if there is no wedding there is no marriage” but at the same time she wont let me help him because of the pressure my mother is putting on him he wants to take out a loan, I told her this and she said it was fine, how could it possibly be fine for us to enter into a marriage with a debt that big? I have the money its not as though I’m steeling from her but she still won’t allow me. Can she do that? And what advise do you have when it comes to talking to my mother because it bothers me that she all of a sudden is changing her mind about what matters, Btw you’ll see that I haven’t mentioned my father I’m not sure if you’ve heard the line but it goes “the man is the head of the house hold but the woman is the neck and she chooses where that head turns” unfortunately in my case this applies. Forgive me for running on. Jazakallahu khair.

Best she consults her guardian

Q. 1) If Sam considers Sarah to be “weak-minded and a quitter,” doesn’t that make Sam an enemy of Sarah? 2) Should Sarah even be married to Sam if he thinks so little of her? Please respond ASAP!

Answers:

1)  No.

2) Best she consults her guardian

Allah Certainly Knows Best.

p.s. the above answer applies if Sam is a Muslim. If he is not a Muslim, and she is a Muslim, they cannot be married. If both are non-Muslims, the matter should be taken to a person of their faith.

menses and prayer in group form

Q. As-salamu Alaykum Imam,

Say a sister while during salah (to be specific Jumu’ah salah 2nd rakat) gets her menstrual cycle; what does she do continue and finish her salah, Say her salam and end it there.
jazakallahu khairan in advance for answering! this just recently happened to me, and I was really confused, so I stayed in salah, finished it with the imam, made dua prayer for it to be accepted.
Would my salah be accepted? the intentions and everything were set before the menstruation came in?
Thanks for taking time out to answer my question. May Allah (SWT) reward you, your family, and your teachers who gave you your knowledge that which you humbly share with us. You’re are a great asset to this community!

Time: Friday October 9, 2009 at 2:28 pm
A. ?????? ?????? ????? ???? ???????

She would end her salah. She would excuse herself from the prayer. If this is not possible, then she would merely make salam and sit down. She would not continue in this state of impurity.

Merely make up that prayer as zohr once menses is over.

Ameen to your duas, may Allah shower His mercy upon you and all those you love, Ameen.

Allah certainly knows best.

p.s. prior to a woman having her menses, some women have a signal that it is to occur. Cramping, etc. She should be sensitive to her body. Best for her to stand in an area that would allow her to excuse herself with maximum ease.

do not confuse circumcision with mutilation

Q.

Assalamu Alaikum-

I need to know what the ruling of female circumcision is before I say things I may regret.  I believe I have already criticized and said things I regret about how female circumcision is not allowed because of what I have heard from ignorant people who present themselves knowledgeable.  Anyway, in my country, there is a wide practice of female circumcision.  What is the Islamic view, and specifically, what did the Allah Ta’aal command and his beloved (SAW) teach us?  Jazakalahu khair and may Allah subhana wataalah brighten your face in this world and in the hereafter!

Time: Wednesday October 7, 2009 at 9:39 pm

A. ?????? ?????? ????? ???? ???????

There is nothing in the Quran or Hadith that stipulates circumcision is obligatory upon female. However, multiple viewpoints exist pertaining to female circumcision. It is viewed from the range of preferable to obligatory (obligatory would NOT be defined as fard, but rather as a highly recommended practice). As the Hadith of Umm Atiyyah states “A woman used to perform circumcisions in Medinah. Rasulullah (sallallaahu alayhi wa sallam) advised her: “Do not cut (so) severely as that is better for the woman and more desirable for the husband.”(Abu Dawood)

Do not confuse matters:

Many confuse female circumcision with female mutilation. Cutting to the extent of a nick, or a little more cannot be equated to the practice of female mutilation of genitalia. Mutilation is forbidden in Islam. The manner in which certain cultures adhere to this practice is not part of Islam. Some cultures adhere to this practice in such a manner that a woman becomes deprived of adult related pleasures later on in life. Islam does not want any person deprived of halal pleasures. People that practice female circumcision without care and consideration, lack the skill and qualification to do so are in essence practicing that which is abhorrent and brutal. To do so with the intent to limit the pleasure of woman with the fallacy that she is promiscuous by nature, and must therefore be removed of her rightful gratification is haram. Such and similar thinking remain baseless.

No choice for men!

Overall, men do not suffer such loss of pleasure. For boys it is obligatory to have them circumcised in their childhood. Here obligatory would be defined as a necessary function for boys.

Choice for woman!

Female (and male) circumcision is allowed by qualified professionals without elements of brutality. It must occur without it facilitating pain later in persons life. If this cannot be ensured, then it is would best to not have it done upon the female. The idea of this  sunnah for woman is not pain or discomfort to the rest of their lives! The same excuse would not apply towards males. They must make a greater effort to make this sunnah possible.

For woman, if laws of a country oppose this practice for woman, laws of the country should be adhered to. Doing so would not be a sin.

Allah Certainly Knows Best.

May Allah (Subhanahu Wata’Ala) accept your daus for all muslims, Ameen.

Jurisprudence and Rulings (Fiqh)

Title    Recently the Sheikh Tantawi, the most senior Sheikh in Jamiatul Azhar – Egypt, declared that Niqab (face veil) has no part in deen and that it is only a culture. The sheikh has also called in for a ban of niqab in the Egyptian Female Institutes. Could you please give us some background on Niqab. Does it really have no basis in Sharia as the Sheikhul Azhar claims?

THE SHARI’ BASIS OF NIQAB (FACE COVERING) AND SHAYKH TANTAWI’S INCORRECT VIEw

INTRODUCTION

Recently, one of the senior scholars of Egypt was invited to address a group of young female high-school students. His gaze fell on a girl who was wearing a face-veil (niqab). This annoyed the Shaykh and he proceeded to ask the supercilious girl to remove her veil. The girl refused to comply, claiming that it was her habit to cover her face in front of strangers. The Shaykh immediately retorted “The niqab is nothing but culture – it has absolutely no place whatsoever with the religion of Islam.” The Shaykh repeated his command and added, in a crude Egyptian dialect, “…and I know the religion better than you your parents.” A teacher also tried to intervene and said to the Shaykh that it was only because of his presence that the young lady was veiling her face. But the Shaykh insisted that the veil be removed. Finally, the young girl had to give in the senior most authority and helplessly unveiled herself. The Shaykh was still not satisfied and humiliated the innocent girl further buy saying in a crude expression Egyptian vernacular “Ama law kunti hilwa shuwaya la-amilti eh?”(If you had even a little beauty I wonder what you would have done?)

He then went on and threatened to banish the niqaab in all public schools affiliated with Al-Azhar. We were also horrified to hear that a month prior to this incident, girls who had their faces covered were not allowed to enter Al-Azhar. Continue Reading →

Gender – Tutor – MSA

Q. 1)

?????? ????? ????? ???? ???????

Is it allowed for men to tutor women and for women to tutor men in both religious and secular subjects? Can a man tutor two women and can a women tutor two men?

Jazakullah khair in advance.

Q 2) In the MSA we got an issue and I want your opinion. Can you share guidelines for tutoring between men and woman/

Time: Monday October 5, 2009

Answers:

?????? ?????? ????? ???? ???????

In a secular setting, the following rules would apply:

  • First preference must be given to the same gender and religion
  • Thereafter, nonmuslim but yet same gender
  • If no substitute exists for this given function (subject), then only would cross gender tutoring be allowed, however, with dislike. It must prove a necessity in a persons life. The education itself must also prove as part of necessity
  • If a mahram exists, then the mahram must present. Rules of hijab must also be maintained even with mahram
  • It should be in a setting wherein an innocent persons name would not tainted
  • Dress code norms must be adhered to. Every law of modesty must be maintained. Appropriate distance would be used as caution. Staring and dazing into the other would not be allowed under any circumstances. Flirting must terminate all interactions
  • The interaction must be limited to fulfilling the function at hand, and nothing more. No exchange of other personal unwanted data, flirtatious texts or emails, etc. must be tolerated.
  • The above answer is based on necessity. If the mischief is greater then good, then such interactions must be terminated in the interest of the good image of MSA – a Muslim organization indeed!
