Q: Assalmalaikum Imam,if the time of salah has happened ie: 1 hour into duhr, should one pray sunnah or just wajib because he/she did not pray early enough?

What do you mean by happened? Do you mean that  a given Salah time is over and new salah time has began? Salah with jamat is over and you still need to pray? Etc
