Q: ASAlamualikum,

Imaam I have sent this question to you befoe and I hope youd kindly answer. We can get the answer from other palces. My pref is you answer it since you are imam and khateeb of Jummah and now the cemetery.

Dear imam what is the ruling on people shouting the kalimah laila ha illalah and saying the shahadah while carring the deceased. Is there a soboob in the deen.

Answer: Walaikumsalam,

Part 1) May Allah (SWT) bless you in seeking clarity from us. May Allah (SWT) also bless our deceased. Our graveyard is part of a new project and we will inshaAllah learn as part of learning Ummah to do things the correct way, inshaAllah, amen. Additionally, may Allah (SWT) bless you for your continual support on Friday as well as your kind words. InshaAllah, it is our duty to live up to your good expectations, amen.

According to Tahtawee alaa Maraaqil Falaah (p353) as well as fatwa Alamgeri, it is not permissible to shout the kalimah, or anything for that matter while carrying the deceased. It is permissible to read softly.

If you could not make the deceased read the kalimah continually while they were alive, there is no way one can make them read it when they are dead. And if they continually read it while they were alive, then alhamdullah, this will help them now that they have moved on. Others reading the kalimah for the dead does not increase the imaan of the dead. And those that are living can only increase their imam if they recite the kalimah as the deen expects of them. Imaan is not increased with shouts of the kalimah in an emotional manner.

Janazah salah in itself is actually a dua. Your presence alone will gain you reward and inshaAllah gain the one that has passed away magfirah (forgiveness.)

Part2) I am not the imam of performing all the janazah Salah. The one that has passed away via a bequest or the representative of the deceased has the right to make the bequest of who is to perform or not perform the janazah salah. If they have requested me to do so, then and then only can I be the imam of that given janazah salah.

Part 3) One does not follow a persons opinion merely because they are an imaam or khateeb. One has to see the reference of answers shared as it relates to deen. (As we have done above.)
